General Terms and Conditions
It is important that these conditions are read carefully before placing an order with us. It is understood that by placing an order with us that these terms and conditions have been read and fully understood.
1. General Guidance
a. Purchase process
i. Please review the sites on our web site that are offering online direct sales. Decide on the style, colour and size as determined by the web site choices and click on the shopping cart icon. Once completed with all your purchases click on the checkout icon and you will see the details of the products you have purchased and also the total bill for those products.
b. Payment terms
i. All orders for online products are to be paid in full at the time of ordering. Payment will be made through PayPal. If payment by credit/ debit card is not possible please contact us on email@example.com and we can arrange payment by BACS or cheque.
c. Product pricing
i. The price for the products will be as current on the web site at time of ordering. All pricing is in UK Sterling and includes VAT for UK purchases. For export purchases out with the UK a price excluding VAT will be calculated.
d. On line product presentation and imagery
i. We try to ensure all our imagery represents accurately the construction of the rug and the colours within the yarns. Different display settings on computer screens can change the appearance of the colour and an image cannot give you the feel of the rug so we recommend you ask us for a free sample of yarns and colours to be sure you are totally satisfied before we make your rug.
e. Product sizing
i. The product is made by hand, here in Scotland, and as such there may be small variations from the nominal size ordered of up to 5%. This is inherent in the manufacturing process and cannot be considered a fault.
ii. The web site calculates pricing for square/ oblong rug shapes. If you require a circular rug or a bespoke shape then please contact us on firstname.lastname@example.org and we will quote separately.
f. Lead time for delivery
i. Each rug is made to order. Lead time for delivery will normally be 4 weeks. If for whatever reason that is likely to be exceeded we will notify you of the expected delay time. Any given lead time must be treated as approximate and does not form part of any contract.
2. Rights to cancellation
a. Customised orders from the web site can be cancelled up to 48 hours from time of receipt of order. Once a bespoke rug is in production refunding the purchase price is not possible.
b. All products for sale on the web site must be considered as custom made items and cannot be returned unless the goods are shown to contain faults. If following collection and inspection the goods are found to be faulty a replacement product will be supplied within our lead times with no additional charges. Faults which can be detected on delivery need to be notified to email@example.com within 3 working days from receipt of the goods. In the unlikely event that a fault appears over time then again use the email address to notify us of the issue.
c. Turnberry Rug Works Ltd has the right to cancel an order if an incorrect price is placed on the website or errors occur due to a malfunction of the ordering software. The order can also be cancelled if the product has become unavailable for any reason. If your order is cancelled by us you will be notified as soon as is reasonable and a full refund made of any monies paid to us. We will not be obliged to offer any further compensation if cancelling an order.
3. Delivery conditions
a. The goods will be delivered to the address as stated on your order at time of receipt. If for any reason those details need to change please contact firstname.lastname@example.org . We cannot accept changes to a delivery address once the goods have been despatched.
b. Delivery is free within the UK mainland and will be made between Mondays to Friday.
c. You will be notified within 5 working days of the likely delivery date.
d. It will be your responsibility to have someone available to take in the delivery. Failed deliveries will go back to the depot and if there are three failed deliveries the goods will be returned to us. We cannot offer timed delivery slots and the delivery will take place at any time between 9am and 5pm.
e. We can arrange for rugs to be despatched out with the UK and please contact us on email@example.com to obtain a quote.
4. Liability and the limits
a. If in the very unlikely event your purchased product is incorrect or faulty then we may at our discretion do one of the following:
i. Replace any shortage or non-delivery
ii. Replace damaged or faulty products following our collection and inspection
iii. Refund the full amount paid for the goods in question.
b. Except for the type of liability for which our liability may not by law be restricted or excluded, our total liability in respect of any contractual breach or representation, statement or tortious act or omission arising under or in connection with these Terms and Conditions shall not exceed the total sums paid by you in respect of those goods.
c. Notwithstanding anything else contained in these Terms and Conditions (and without limiting our liability in respect of injury to or death of any person to the extent we cannot limit by law), we shall not be liable to you for:
i. any losses which are not foreseeable by both parties when the order is placed arising in connection with the supply of goods or the use of goods by you;
ii. any losses which are not caused by any breach by us or are caused by your negligence; or
iii. Business or trade losses.
d. We shall not be liable to you for any loss arising out of any failure by you to comply with your obligations under these Terms and Conditions.
e. Nothing in this clause 4 shall confer any right or remedy upon you to which you would not otherwise be legally entitled.
f. We shall not be liable to you if we are prevented or delayed in the performing of any of our obligations to you if this is due to any cause beyond our reasonable control including (without limitation): an act of God, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure by you to give us a correct delivery address or notify us of any change of address.
g. The contract between us shall be governed by and interpreted in accordance with Scottish law and the Scottish courts shall have jurisdiction to resolve any disputes between us.
